Terms and Conditions of Sale

The purpose of these General Terms and Conditions of Sale (here in after the “Terms and Conditions” or “T&Cs”) is to define the respective obligations

of the company operating the "Chalets de l’Observatoire" and the customer.

The reservation of an apartment implies the customer’s unconditional acceptance of these Terms and Conditions. These Terms and Conditions have

been drafted in accordance with applicable laws and regulations and govern the conditions under which furnished holiday apartments with para-

hotel services are offered for seasonal and tourist rental purposes.

The T&Cs may be amended at any time without prior notice. In such event, any amendments shall take effect upon publication online and shall apply

only to reservations made after the date of publication.

The customer acts both on their own behalf and on behalf of all persons included in the reservation. The customer warrants that they are duly

authorized to act in this capacity, guarantees the accuracy of the information provided, and undertakes personal responsibility for all persons

included in the same reservation.

This agreement falls within the legal framework governing seasonal tourist rentals pursuant to Articles 1708 et seq. of the French Civil Code and is

governed by the provisions applicable to service contracts.

Any accommodation made available under this agreement is provided solely as temporary lodging. The customer undertakes not to carry out any

commercial, artisanal, professional, tourist, or self-employed activity on the premises.

The customer may not rely on the legal provisions applicable to residential tenancy agreements, including those arising under French Law No. 89-

462 of 6 July 1989 governing residential leases, particularly with regard to any right to remain in the premises.

1. Booking & Payment

A reservation is confirmed and becomes binding upon receipt of a 25% deposit of the total stay amount, payable within five (5) business days of booking confirmation.

The remaining balance (75%) is due no later than thirty (30) days prior to arrival. Failure to receive payment within this timeframe may result in cancellation of the reservation by Les Chalets de l’Observatoire.

All rates are quoted in euros (€), inclusive of VAT, excluding local tourist tax and any optional services or experiences.

2. Security Deposit

A €3,000 pre-authorized security deposit per apartment is required upon arrival.

Guests are responsible for any damage, loss, or deterioration caused during their stay by themselves, their occupants, or visitors. Any associated costs for repair or replacement may be charged accordingly.

The pre-authorization will be released within a maximum of seven (7) days following departure, subject to a satisfactory property inspection.

3. Cancellation Policy

More than 90 days before arrival: full refund of amounts paid, less a €150 administrative fee.

Between 90 and 60 days before arrival: 50% of amounts paid will be refunded.

Between 60 and 30 days before arrival: the deposit remains due.

Less than 30 days before arrival, no-show, or early departure: the full stay remains payable.

Cancellation insurance is available upon request.

4. Payment Terms

Payments may be made by credit card (Visa, Mastercard, American Express), bank transfer, or any digital payment method offered at the time of booking. Online transactions are processed through a secure payment platform.

On-site payments may also be made in cash (within applicable legal limits), by ANCV holiday vouchers where applicable, or, for corporate clients, by lodged card or bank guarantee.

Personal cheques are not accepted.

5. Arrival & Departure

Check-in is available from 4:00 PM. Check-out must be completed by 11:00 AM.

The maximum occupancy of each apartment must not be exceeded. Les Chalets de l’Observatoire reserves the right to refuse access to any person not declared at the time of booking.

Small pets under 9 kg (20 lbs) are welcome upon prior approval and subject to applicable fees.

Any unreturned key, remote control, or access device will be charged at replacement cost.

6. House Rules & Enjoyment of the Property

The property is offered exclusively as a private luxury holiday residence.

Guests are expected to respect the tranquility of the property, the neighborhood, and the residence rules at all times.

Only pets weighing less than 9 kg are permitted, subject to prior request and the establishment’s express approval.

For the comfort and safety of all guests, the following are strictly prohibited:

• Smoking inside the property (any breach will result in additional cleaning and restoration charges);

• Parties, events, receptions, or any unauthorized gatherings;

• Subletting or granting access to third parties not registered in the booking.

Any serious breach of these rules may result in immediate termination of the stay without refund.

Guests remain fully responsible for the behavior and actions of all occupants and visitors.

7. Property Inspection & Assistance

A full property inspection is carried out before arrival and after departure by Les Chalets de

l’Observatoire.

Any issue or discrepancy must be reported within 48 hours of arrival to be considered.

8. Liability

Les Chalets de l’Observatoire cannot be held responsible for loss, theft, or damage to guests’ personal belongings during their stay.

Any concierge services or third-party experiences arranged during the stay are provided by independent suppliers and remain under their sole responsibility.

Neither party shall be held liable in the event of force majeure as defined under French law.

The Client certifies that they have taken out civil liability insurance covering any damage that may be caused to the apartment during their stay.

The Client shall be liable for all damage caused by themselves, as well as by any persons or animals under their responsibility, and undertakes, in the event of damage to the premises made available to them, to bear all costs associated with restoring the premises to their original condition.

9. Personal Data and Applicable Law

The Data Controller may collect this data for the purposes of managing bookings and customer relationships, invoicing and payment processing, marketing, promotional and commercial activities, commercial statistics, and customer satisfaction surveys.

Failure to provide the requested information may prevent Les Chalets de l’Observatoire from processing and recording a reservation.

The data is intended for the company operating Les Chalets de l’Observatoire, as well as its service providers.

10. Disputes

It is expressly agreed that any dispute relating to the interpretation and performance of this agreement shall fall under the exclusive jurisdiction of the courts having authority over the location of the registered office of the operating company and shall be governed by French law.
