2. Acceptance of Terms of Use
This document is intended to define the terms and conditions (hereinafter the "Terms of Use" or "ToU") under which the Company makes available to users (hereinafter the "Users") the ability to browse and use the Site.
Use of the Site implies full, complete and unreserved acceptance of these ToU.
3. Use of the Site
Before using the Site, the User must ensure that they have the technical and IT means required to browse and use the Site. They must also ensure that the IT configuration of their hardware/equipment is in good working order and does not contain any viruses.
The Company reserves the right to modify, revise, delete, validate or change, in whole or in part, any content (hereinafter "Content") appearing on or displayed on the Site.
The Company may delete, change or modify the Site and/or its Content at any time.
4. User Obligations
By using the Site, Users agree:
- to refrain from using the Site illegally, for any illegal purpose or in a manner inconsistent with these ToU;
- not to use the Site to publish insulting, defamatory, harassing, obscene, pornographic or threatening content, and/or content that infringes the privacy of others;
- not to sell, copy, reproduce, rent, lend, distribute, transfer or sublicense all or part of the elements, information and Content on the Site and/or allow any third party to use or access the Site for any purpose, or to decompile, reverse engineer, disassemble, modify, display in human-readable form, attempt to discover any source code or use any software activating or comprising any part of the Site;
- to respect other Users;
- not to collect and store personal data relating to other Users for any purpose;
- not to disseminate content that could constitute incitement to commit crimes or offences, provocation to discrimination or racial hatred, or more generally content that could be contrary to applicable laws and regulations, these terms of use, public morality and public order;
- not to disseminate information of an ideological, religious, political or ethnic nature;
- not to disseminate content likely to endanger minors, in particular violent or pornographic material;
- not to attempt to mislead other Users by impersonating other individuals;
- not to display, transmit by email or otherwise any element that violates any patent, trademark, trade secret, intellectual property right or any other proprietary right belonging to others;
- not to display, transmit by email or otherwise any unsolicited or unauthorised advertising or promotional material (including spam or any other form of solicitation);
- not to misuse the Site by deliberately introducing viruses or any other malicious software and not to attempt to gain unauthorised access to the Site;
- not to denigrate the Site and/or the Company and/or other Users on social networks or any other means of communication.
If, for any reason, the Company considers that Users are not complying with these ToU, it may at any time, at its sole discretion, remove their access to the Site and take all measures including legal action against them.
5. Accuracy and Lawfulness of Information
Each User undertakes that all information they provide, including information about themselves, is adequate, accurate, up to date and complete. To this end, they undertake to update it regularly.
The User acknowledges that the Company does not have the material means to verify the accuracy of all information present on the Site.
The Company therefore cannot be held liable in the event of identity theft, or in the event that the information provided is false or misleading.
The Company also does not guarantee the appropriateness, lawfulness, integrity or quality of information transmitted by Users.
6. Intellectual Property
By accessing the Site, Users expressly acknowledge that the Site and the Content made available to Users, including images, photographs, design, graphics, drawings, models, layouts, logos, trademarks, texts, etc., are the exclusive property of the Company and are protected by French intellectual property law as well as applicable international treaties and agreements relating to the protection of intellectual property rights. As such, they may not be reproduced without the express authorisation of the Company, under penalty of civil and criminal proceedings.
The Company is the sole owner of all rights, titles and interests in the Site and the Content, including all intellectual property rights, including in particular all rights relating to copyright, design rights, trademarks, trade names, commercial names, company names, domain names, technology, know-how, processes, formulas, source codes and executable codes, data and similar rights, including information relating to any application, registration or renewal thereof that may be protected by intellectual property laws, regulations or rules of any country.
The Company grants Users a non-exclusive licence to use the Site and the Content strictly within the framework of these ToU.
Any reproduction, representation, adaptation, exploitation, distribution, dissemination, commercial use, translation, arrangement, transformation or creation of derivative or composite works of all or part of the works and/or any other Content appearing on the Site, on any medium and by any process, whether current or future, is expressly prohibited. Such acts may constitute acts of infringement subject to criminal and civil penalties, engaging the liability of their author.
The systematic and repeated extraction of information and Content appearing on the Site is strictly prohibited and sanctioned under intellectual property law and the sui generis right of databases. Any unlawful extraction may engage the civil and criminal liability of its author.
7. Liability
The Company disclaims all liability for any damage resulting from the fraudulent intrusion of a third party, beyond its control, which has led to the modification or alteration of information/Content on the Site or which has caused harm to any User of this Site; and more generally for any damage, whatever its causes, origins, nature or consequences, caused by anyone's access to the Site or inability to access it, beyond its control.
The Company cannot under any circumstances be held liable for technical problems or failures related to telephone networks, online computer systems, servers, internet service providers, computer equipment and/or User software.
The Company disclaims all liability in the event of a delay in updating, as well as in the event of temporary interruption or unavailability of the service.
8. Links
Hypertext links established on the Site to other websites or other internet sources or content (hereinafter "External Sources") shall not engage the liability of the Company.
Since the Company cannot control these External Sources, the User acknowledges that the Company cannot be held liable for the availability of these External Sources, and cannot bear any liability for the content, advertising, products, services or any other material available on or from these External Sources.
9. Trademark Information
"LES CHALETS DE L'OBSERVATOIRE" and all trademarks and logos belonging to the Company are trademarks protected by French intellectual property law (hereinafter collectively referred to as the "Trademarks"). Unless expressly authorised in writing by the Company, the User undertakes not to use or disseminate the Trademarks in any way whatsoever. This prohibition extends to all signs reproducing the Company's Trademarks, such as, without limitation: company names, trade names, business names, domain names, designs or models, etc.
10. Personal Data Protection
The provisions relating to personal data protection are set out in the Privacy Policy available on the Site.
11. Opposition to Telephone Canvassing
In accordance with Article L. 223-3 of the French Consumer Code, consumers have the right to register on the telephone canvassing opposition list. The relevant article is Article L. 223-3 of the Consumer Code, which states:
"When a professional collects telephone data from a consumer, they shall inform the consumer of their right to register on the telephone canvassing opposition list. When this information is collected in the context of the conclusion of a contract, the contract shall clearly and comprehensibly mention the existence of this right for the consumer."

12. Applicable Law and Jurisdiction
These ToU are governed by and interpreted in accordance with French law, without regard to conflict of law rules.
In the event of any dispute arising in connection with the interpretation and/or performance of these ToU, the competent courts shall be those designated in the French Code of Civil Procedure.
13. Language
These ToU are written in French. In the event that they are translated into one or more foreign languages, only the French version shall prevail in the event of a dispute.
